PRIVACY STATEMENT HORTIPOINT
1 Introduction
The Hortipoint Foundation (hereinafter referred to as “Hortipoint”), to which the media brands Hortipoint, Vakblad voor de Bloemisterij, The Tree Nursery, Garden and Landscape, Bloem & Blad en Floribusiness belongs, is convinced that the protection of the privacy of its customers and visitors to its websites is essential for its activities. Personal data of customers and visitors are therefore treated and secured with the utmost care. Hortipoint adheres to the requirements of the Personal Data Protection Act and other privacy legislation.
The person responsible for data processing is Stichting Hortipoint, Rijnsburgersingel 61, 2316 XX in Leiden, registered with the Chamber of Hope trade under number 41150956.
2. Processing of personal data by Hortipoint
Based on the different ways in which we obtain personal data, we explain in this privacy statement which data we collect and for what purposes we use it.
Hortipoint is constantly working to optimize and renew its products and services. That is why we use the personal data we obtain for analysis purposes and to adjust and improve our services. We try to personalize our communication as much as possible. Personal data may further be used to prevent fraud and to secure our websites, apps, products and services.
Below is an explanation of the purposes for which Hortipoint uses personal data, whereby we indicate in each case the different ways in which we obtain personal data, what data we collect and for what purposes we use this data. The legal basis for this processing of personal data by Hortipoint is always the performance of the agreement with you, your consent and/or the representation of a legitimate interest (such as the interest in being able to send marketing information) of Hortipoint or of a third party.
a. Sale of subscriptions, products and services
Hortipoint records data in the context of its services. This is the case when you subscribe to a publication or newsletter (digital or printed), visit an event or master class, order a publication, or purchase other products/services from Hortipoint.
Hortipoint processes contact details (including name, address, telephone number and e-mail address) and transaction details (including bank and payment details) in order to be able to execute the agreement with you, to deliver these products and services and to keep you informed of its course. The processing operations referred to above take place on the basis of the agreement between you and Hortipoint.
b. Visit a Hortipoint website
Hortipoint offers various websites. If you use Hortipoint websites, we collect personal data in order to provide you with a good service. For example, we use cookies and scripts to improve the functioning of the websites. We also place tracking cookies and scripts on some websites to analyze your surfing behavior.
Some Hortipoint websites use cookies and similar techniques to recognize and track you online and to monitor your click and mouse behaviour.
Insofar as it concerns other than functional cookies, these processing operations are based on your consent obtained via the cookie bar. In the cookie statement you can read which cookies are placed for which purposes.
c. Participation in online promotions and competitions
Hortipoint can organize online promotions and contests through various channels. The data you provide to Hortipoint in that context will be used for the implementation of the promotion or competition in question.
d. Participation in online test and surveys
On some Hortipoint websites you can participate in tests and/or surveys. The data you enter in this context will be used to carry out the test or survey.
e. Participation in online forums
On some Hortipoint websites you can leave messages on a forum or respond to certain statements. The information you enter will be made visible on the relevant forum.
f. Sending the newsletter
You can register for a newsletter on some Hortipoint websites. This data is used to send you the newsletter.
g. Subscriber login codes
If you subscribe to a Hortipoint edition, you will automatically receive a login code.
h. Use of social media
Hortipoint is active on various social media, such as Facebook, Instagram, Twitter, Pinterest and YouTube. If you follow us on social media, Hortipoint may gain access to part of your profile data. Hortipoint also follows social media channels itself and can in this way gain access to data on social media about you.
i. Marketing research
Hortipoint occasionally conducts market research. If you wish to participate in market research, the information you provide will be used by Hortipoint to improve its products and services.
j. Click behavior and IP address
General visitor data is recorded on the Hortipoint websites, without identifying the visitors. The purpose of this is to optimize the layout of the website. This data can also be used to put more targeted information on the site. In this way, Hortipoint can further optimize its services to you. To do this, Hortipoint also uses the IP address of your computer. This IP address is a number that is automatically assigned to your computer when you visit the Internet. They can be used to see what use is made of the website and to prepare analyzes and reports. In principle, the IP addresses are not further linked to identifiable information, unless you have given explicit permission for this.
k. Customer service Hortipoint
There are various ways to contact Hortipoint's customer service, including by telephone and e-mail. Customer service may ask you for certain contact details such as name, address, email address and telephone number. This data is used to handle the questions. In addition, this data is stored so that we can also provide you with a better service at a later stage. Finally, we use this data to improve our products and services. The basis for this is the legitimate interest of Hortipoint.
3. Communication from Hortipoint
Hortipoint would like to keep you informed by e-mail about news, offers, promotions and events from Hortipoint and the brands/titles that fall under Hortipoint (see above).
You can sign up for communication from Hortipoint in various ways, for example by subscribing to a newsletter. If you have purchased something from Hortipoint, Hortipoint can use your e-mail address to inform you as a customer about similar products and services from Hortipoint that are relevant and interesting to you, unless you have indicated at the time of your purchase that you do not appreciate this.
If you no longer wish to receive newsletters or other commercial information, you can unsubscribe at any time.
It is also possible that you have agreed that the e-mail address you provided will be used to occasionally receive relevant information about products, offers and promotions from companies other than Hortipoint. You can also unsubscribe from this notification at any time.
4. Disclosure of your personal data to third parties
Hortipoint sometimes engages third parties to process your data, for example IT suppliers (such as Spotler for sending newsletters) and delivery services. These third parties act as processors for Hortipoint. Hortipoint ensures that these processors offer sufficient guarantees with regard to technical and organizational security measures. Hortipoint enters into a processing agreement with these parties. This agreement states, among other things, that the personal data will only be processed in and according to orders from Hortipoint.
5. Security
Hortipoint takes appropriate technical and organizational measures to protect your personal data against loss or unlawful processing. We secure our systems and applications according to the applicable standards for information security.
6. Your rights
Objection/Unsubscribe
If you do not appreciate information about (new) products and services (by post, e-mail, etc.), you can report this by e-mail to info@hortipoint.nl or in writing to Hortipoint, attn. administration, Rijnsburgersingel 61, 2316 XX in Leiden. The mailings that Hortipoint sends always include an option to unsubscribe.
Inspection and correction of your data
You can view the personal information that Hortipoint has about you. If the information is incorrect, you can request that it be corrected. Such requests for inspection or correction of your data can be sent to Hortipoint, PO Box 9324, 2300 PH in Leiden, or via info@hortipoint.nl. Hortipoint will respond to such requests as quickly as possible, but at the latest within four (4) weeks.
Removal
If you want Hortipoint to delete your personal data and/or account, you can send your request to info@hortipoint.nl. A number of personal data may also be retained by Hortipoint after your request, for example because this is necessary to process orders already placed or if there is a legal obligation to retain the data.
Processing limitation
If you have valid reasons to request a limitation of the processing, for example because you dispute the correctness of the personal data processed by Hortipoint, or you have objected to the processing of personal data by Hortipoint, you can request this by sending an e-mail. send to info@hortipoint.nl.
Data Portability
If the processing of personal data by Hortipoint is based on your consent and is carried out via automated processes, you can request to receive the personal data concerning you and that you have provided to Hortipoint in a structured, commonly used and machine-readable format. You can make this request by sending an email to info@hortipoint.nl.
Complaint
If you have a complaint about the use of personal data by Hortipoint, you have the right to submit a complaint to the Dutch Data Protection Authority.
7. Retention Periods
Hortipoint does not store personal data for longer than is necessary for the purpose for which it was collected or processed. Hortipoint sets retention periods for each purpose and category of data. Hortipoint's retention period policy can be found here [link].
8. Transfer to countries outside the EEA
Your personal data will only be stored or processed outside the EEA by Hortipoint or third parties engaged by Hortipoint if this is in accordance with the applicable regulations for the transfer of personal data to countries outside the EEA.
9. Hortipoint and other websites
On the Hortipoint sites you will find a number of hyperlinks to other websites. However, Hortipoint cannot bear any responsibility and does not accept any liability with regard to the handling of your data by those parties. Please read the privacy statement, if any, of the site you are visiting.
